Employee Mobile Messaging Consent & BYOD Agreement
SMS Terms & Mobile Communications Policy
This Employee Mobile Messaging Consent & BYOD Agreement (“Agreement”) is entered into between Hamptons Boat Management Inc. (“Company”) and the signing employee (“Employee”). This Agreement governs the Company’s use of SMS text messaging to deliver operational communications to the Employee’s personal mobile device and constitutes the Employee’s formal opt-in consent for such communications.
Purpose & Scope of Messaging
All SMS communications sent by the Company will carry the prefix Yacht Hampton:. Messages are strictly operational and will never be used for marketing, promotional, or advertising purposes.
- Daily task assignments and to-do lists
- Calendar events, scheduling updates, and shift reminders
- Emergency and safety notifications related to vessel operations, weather, or personnel matters
Message Frequency
Messages will be sent at least once per day during active employment, with a typical maximum of approximately 8 messages per day during peak operational periods. Standard messaging hours are 8:00 AM to 7:00 PM; however, individual schedules vary by role and assignment. The Company will not send messages outside of an Employee’s working hours unless the communication relates to an emergency or safety matter.
Opt-In Consent
By signing the accompanying agreement, the Employee affirmatively consents to receive SMS text messages from Hamptons Boat Management Inc. at the mobile number provided. The Employee confirms that:
- They are the account holder or have authorization from the account holder to consent.
- The mobile number provided is accurate and current.
Opt-Out & Help Instructions
The Employee may opt out of SMS communications at any time using any of the following methods:
- Reply STOP to any message. No further messages will be sent unless new consent is provided.
- Reply HELP to any message for instructions and support contact information.
- Contact Manager Joe Iallaci at joe@yachthampton.com. Requests submitted via email will be processed within 24 hours.
- Notify your direct supervisor verbally and follow up in writing.
- Submit an opt-out request through the Company’s employee application, if applicable.
Following any opt-out, the Employee acknowledges they may miss time-sensitive operational communications and accepts responsibility for obtaining such information through alternative channels. The Company is developing Slack-based messaging as an alternative; employees who opt out of SMS may be transitioned to that channel when available.
Carrier Compliance Notice
Message and data rates may apply. The Company is not responsible for any charges or fees incurred by the Employee’s mobile carrier in connection with the receipt of SMS messages. The Employee is solely responsible for managing their mobile carrier plan. Employees on limited or pay-per-text plans are encouraged to consider whether SMS opt-in is appropriate for their plan; opting out via STOP or by contacting a manager is available at any time. Delivery is not guaranteed across all carriers.
Privacy & Data Use
6.1 Internal Use Only
The Employee’s mobile number will be stored securely within the Company’s internal systems and accessed only by authorized personnel responsible for managing employee communications. It will not be used for any purpose beyond the operational scope defined herein.
6.2 Data Retention
The Employee’s mobile number will be retained for the duration of employment and for up to 90 days following separation, after which it will be purged from all active messaging systems.
Bring Your Own Device (BYOD)
The Employee acknowledges and agrees that:
- The device used to receive Company SMS communications is personally owned and is not Company property.
- The Employee is solely responsible for the physical security of their device, including protection of messages received.
- The Employee is solely responsible for all carrier plan costs, including any data or messaging charges.
- Unauthorized persons must not be permitted access to Company operational messages on the device.
- The Company is not liable for any loss, damage, or unauthorized access related to use of a personal device.
- Upon loss, theft, or compromise of the device, the Employee must notify the Company immediately by contacting Joe Iallaci at +1 (631) 455-1401, emailing joe@yachthampton.com, or informing their direct supervisor.

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of the State of New York.
Entire Agreement & Amendments
This Agreement constitutes the entire agreement between the parties with respect to employee SMS communications and supersedes any prior agreements or understandings on the subject matter. The Company reserves the right to amend this Agreement with a minimum of 7 days’ written notice to the Employee. Continued use of Company SMS communications following the notice period constitutes acceptance of the amended terms.
